Here is an interesting article by David Balto in the Huffington Post that compares the House and Senate healthcare bills on competition issues and suggests how the Senate bill needs to be strengthened.
The suggestions include the elimination of the health insurance antitrust exemption, broadening FTC jurisdiction so it can attack anticompetitive and deceptive conduct by health insurers, prohibiting exclusion payments by pharmaceutical companies that keep generics off the market, and stronger PBM regulation.
